Consent to the processing of personal data

A brief overview

We take the protection of personal data very seriously. Here we inform you about how we process your personal data and what claims and rights you have in accordance with legal regulations on personal data protection.

We mainly process the following categories of personal data concerning you: registration data in the FitBelly reservation system: name, e-mail and telephone number, preferences regarding e-mail advertising.  

You provide this data partly directly (eg as part of registration) and partly obtained automatically (eg by e-mail correspondence).

• Purposes of personal data processing

We process your personal data primarily to provide services in connection with the FitBelly exercise program, including information about services tailored to your interests.

 

• Legal basis

The processing of your personal data is necessary primarily for the purpose of making reservations for group exercises and for the purpose of contacting you if necessary.

If the law requires your consent, for example for a specific e-mail ad, we will ask for that consent.

 

• Categories of recipients of your personal data

The exclusive processor of your personal data is Ivana Delmotte Chalupecká, via the web application www.wix.com

 

• Time of storage of your personal data

We usually process and store your personal data for a period of 2 years from your last login to the reservation system or from the last communication.

 

• Your rights to personal data protection, in particular the right to refuse

Under certain conditions, you can enforce your privacy rights against us. In particular, we would like to draw your attention to your denial rights:

If there are certain reasons arising from your special situation, you have the right to refuse the processing of your personal data if we justify the processing of personal data by consideration of interests or if the processing of personal data concerns profiling or direct advertising. In this case, we will no longer process your personal data.

 

• Voluntary provision of personal data

There is no legal obligation to provide your personal information to FitBelly. However, if you do not provide us with your personal information, you will not be able to register for the group exercise. Providing your personal information is entirely voluntary. If you do not provide your personal data, you will not suffer any legal damage, but you will not be able to enjoy the benefits and services of FitBella.

Specific information on the legal protection of personal data

 

1. Person responsible for processing personal data and contact details

2. Categories of personal data

In order to make reservations for group lessons and e-mail communications, we obtain and process the following categories of personal data.

Based on your request for FitBelly services (group or private lessons) via e-mail communication

You provide this information partly directly (eg as part of lesson registration) and partly obtained automatically (by e-mail communication).

3. Purposes of processing

We process your personal data in accordance with Section 5 (2) of Act No. 101/2000 Coll., On Personal Data Protection and since the entry into force of Regulation (EU) No. 2016/679 of the European Parliament and of the Council, General Regulation on Personal Data Protection ( hereinafter referred to as "GDPR")  for the following purposes:

• possibility of individual communication and recommendation of services in accordance with your requirements
• e-mail advertising
• Improving FitBella services
• compliance with legal regulations
• exercising, implementing and defending legal claims

 

4. Legal basis

The processing of your personal data within the FitBelly exercise program is permissible because it is necessary to establish a contractual relationship with you in order to attend the lesson and because we have a predominantly legitimate interest.  

If the law requires the consent of the person, for example for a certain e-mail advertisement or for certain categories of cookies, we will request that this consent be granted. If this consent is not granted, we do not carry out personal data processing processes that unconditionally require consent.

Legal standards regarding permits, such as time limits for storing information with respect to tax law or the exercise, exercise and defense of legal claims, permit the processing of your personal data.

 

5. Recipients or categories of recipients of your personal data

  • Service Providers: We work with the www.wix.com website service provider who has access to your personal information.

 

6. Time of storage of your personal data

We usually process and store your personal data for a period of 2 years from the last day of your login to the ordering system, or from the last communication.  

7. Your rights to personal data protection

Under certain conditions, you can assert your personal data protection rights against us:

 

Right to withdraw consent: If you have given your consent with regard to certain types of personal data processing, you can withdraw this consent at any time with effect for the future. However, this revocation does not limit the legitimacy of the processing of personal data prior to this revocation of your consent or if such processing can be justified by another legal basis.

Right of rectification: At your request, we will correct your stored personal data in accordance with Article 16 of the GDPR if they do not agree or are incorrect.

Right of erasure: If you wish, we will erase your personal data in accordance with the provisions of Article 17 of the GDPR.

  Right to restrict processing: Subject to the requirements of Article 18 of the GDPR, you may require us to restrict the processing of your personal data.

Right of refusal: You can also refuse the processing of your personal data in accordance with Article 21 of the GDPR. You have this right of refusal if there are certain reasons arising from your special situation and only for the processing of personal data, the legitimacy of which is based on consideration of interests, concerns profiling or is carried out for the purpose of direct advertising. In this case, we will no longer process your personal data unless we are legally entitled to reject your refusal. However, the refusal of direct marketing, including profiling, is binding on us and we will no longer be allowed to process your personal data for these purposes. If you have given your consent to direct advertising and no longer wish to receive such direct advertising, you must withdraw your consent.

Right to transfer personal data: You also have the right to receive your personal data in accordance with the provisions of Article 20 of the GDPR in a structured, common and machine-readable format or to pass it on to a third party.

Complaints from the Data Protection Authority: You also have the right to lodge a complaint with each relevant Data Protection Authority (Article 77 GDPR). However, we recommend that you first send your complaints to the person in charge, Ivana Chalupecká. For the purpose of fast processing, we ask you to send your requests for the exercise of your rights in writing to the following e-mail address: fitbelly@email.cz

8. Scope of your obligations to provide us with your personal data

There is no legal obligation to provide your personal data to Ivana Delmotte Chalupecká - FitBelly. However, if you do not provide us with your personal information, you will not be able to register for the group exercise or e-mail communication will not be possible. Providing your personal information is entirely voluntary. If you do not provide your personal data, you will not suffer any legal damage, but you will not be able to enjoy the benefits and services of FitBella.

 

9. We use cookies on the website

When browsing the website, the administrator records your IP address, how long you stay on the page and from which page you come. The administrator is authorized to use cookies to measure website traffic and customize the display of websites.  For example, cookies help: to ensure the correct functioning of our website, in determining which pages and functions are most frequently used; based on which we can best adapt our offer to your requirements.

10. Analytical data

We use tracking tracking codes for the following reports on the web: Google analytics metrics for measuring web traffic, Facebook Pixel metrics.
